Biblical times at no cost to transfer the loan from one bank to another? From today, the customer may obtain compensation. With the publication yesterday in the Official Gazette of the law of conversion of 'anti-crisis last Dl (78/2009) it actually becomes the norm that provides a penalty of '1% of the value of the mortgage for each month or part month of delay in case where the substitution does not occur within 30 days from the date of the request by the assignee bank (the new) to the bank transferor (the old). In practice, if the operation is slow to move to be made, a borrower who has applied to transfer a loan from the residual value of 100 thousand euro could get a refund of a thousand euros per month (or fraction of a month) late. A bank will pay outgoing, which will have the option of entering on that claim if the delay was attributable to the latter.
By this standard the Government expects to eliminate or at least minimize the problems that arose immediately in the application of so-called "portability at no cost" introduced by now more than two years ago by the Bersani Decree. Hitches repeatedly witnessed also by the messages sent by readers Mortgages 24 and have even led the Antitrust Authority to impose nell'agosto2008 at 23 institutions operating on Italian soil fines for about 10 million for "unfair trade practices" (penalty then canceled Tar from among the subject of controversy and soon new assessment by the Council of State). Now you try with the sanctions, even though at the moment is not yet clear what is the procedure to be followed by the borrower once after the 30 days (check with the bank's transferor or the transferee? Submit a written request?) And who is actually intended to monitor compliance with the new rules.
